Terms and conditions
These Terms and conditions (the "Terms") govern the use of Pipochat: the web application, the mobile applications, the API and our websites (together, the "Service"). Pipochat is a WhatsApp Business, messaging and CRM platform for sales and support teams.
By creating an account or using the Service you accept these Terms on behalf of the company you work for ("you" or the "Customer"). If you do not agree, do not use the Service.
1The Service
Pipochat lets a company serve its customers on WhatsApp, Messenger and Instagram from a shared inbox, with a CRM, automations, broadcasts, WhatsApp Flows, integrations and artificial intelligence features. The features available depend on your plan.
The Service is designed for businesses and professionals, not consumers. By accepting these Terms you represent that you have the authority to bind the company you represent.
2Accounts and users
- Each workspace has at least one administrator, who invites team members and sets their roles and permissions.
- You are responsible for keeping credentials confidential and for all activity in your workspace. We recommend turning on two-factor authentication.
- Tell us immediately if you suspect unauthorized access.
- You are responsible for the people who use your workspace complying with these Terms.
3Acceptable use
You may not use the Service to:
- Send spam, unsolicited bulk messages, or messages to people who have not given consent where the law or the channel’s policies require it.
- Break laws or regulations, including data protection and consumer protection law.
- Send content that is unlawful, misleading, fraudulent, defamatory, harassing or that infringes the rights of others.
- Impersonate another person or company.
- Attempt unauthorized access to the Service, to other workspaces or to our systems; circumvent usage limits; or reverse engineer the Service.
- Use the Service in a way that could damage or overload it or harm other customers.
We may suspend sending, or a workspace’s access, when this section is breached, notifying you where possible.
4WhatsApp and other third-party channels
Messages are sent and received through third-party platforms, such as Meta’s WhatsApp Business Platform. By connecting them you also accept their terms and policies — in particular the WhatsApp Business Messaging Policy and Meta’s Community Standards — and you are responsible for complying with them.
Meta charges for WhatsApp conversations at its own rates. Those charges are separate from Pipochat’s price unless agreed otherwise in writing.
We do not control those platforms: if Meta limits, suspends or changes a channel, a number or a feature, that may affect the Service without being our responsibility. We may suspend a connection whose use puts Pipochat’s standing with Meta at risk.
5Your data and your customers’ data
The contacts, conversations, files and other content you upload or receive in the Service are yours. You grant us a limited licence to process them solely to provide, maintain and protect the Service.
For your customers’ data you are the controller and Pipochat acts as your processor, following your instructions. You are responsible for having a legal basis to process it and for any consent or opt-in required before messaging them.
Our Privacy Policy, which forms part of these Terms, explains how we handle personal information.
6Artificial intelligence features
If you turn on AI features — agents, summaries, suggestions or conversation analysis — you acknowledge that:
- Responses are generated automatically from the instructions, knowledge base, information and configuration you define. You are responsible for that content and for keeping it up to date.
- They may contain errors or be inappropriate, and we do not guarantee their accuracy or completeness.
- An AI agent writes on behalf of your company, not Pipochat. Pipochat is not a party to the relationship between your company and your customers and takes on no obligation for what an agent tells them: the prices, discounts, availability and conditions that apply are the ones your company confirms.
- We recommend telling your customers that automatic replies are for guidance only; the agent settings suggest a line for that.
- You are responsible for reviewing your agents' configuration and conversations, for what is sent on behalf of your company, and for clarifying or correcting with your customers whatever is needed.
7Integrations and API
Integrations with third-party services (such as Google, Meta, or your own systems through the API and webhooks) are also governed by those third parties’ terms. You are responsible for the API credentials you create and for what is done with them. We may limit API usage to protect the stability of the Service.
8Pricing and payment
- Current prices are listed on pipochat.com or in the commercial proposal we agree. Unless agreed otherwise, the license is billed monthly in advance, in US dollars.
- We do not charge for the number of contacts or for messages sent from the platform: you pay for the license and for the additional operators and numbers you add.
- Prices may not include applicable taxes.
- We may change prices with at least 30 days’ notice; the change applies from the following period.
- If an invoice remains unpaid, we may suspend access after notifying you.
9Availability and support
We work to keep the Service continuously available, but we do not guarantee it will run without interruptions or errors. We may interrupt it temporarily for maintenance, updates or causes beyond our control, giving advance notice of planned maintenance.
We provide technical support by email on business days. Plans for large teams may include additional support as agreed.
10Intellectual property
The Service, its software, its design and the Pipochat brand belong to us or our licensors. These Terms grant you a non-exclusive, non-transferable right to use the Service while your account is active, and transfer no other rights.
11Term, cancellation and suspension
- There is no lock-in: you can cancel your account at any time. Cancellation takes effect at the end of the period already billed, and partial periods are not refunded unless the law provides otherwise.
- We may suspend or close an account that breaches these Terms or the policies of the connected channels, or whose use puts the Service or other customers at risk.
- For 30 days after cancellation you can ask us for an export of your contacts and conversations. After that, we delete the data as described in the Privacy Policy.
12Warranties and limitation of liability
The Service is provided "as is". To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, data or business opportunities arising from the use of the Service.
Our total liability for any claim relating to these Terms will not exceed what you paid us in the three months before the claim.
Nothing above limits liability that the law does not allow to be limited.
13Changes to these Terms
We may update these Terms. If the changes are material, we will notify you by email or in the app with reasonable notice. Continuing to use the Service after the effective date means you accept the updated Terms.
14Governing law and jurisdiction
These Terms are governed by the laws of the Argentine Republic. The parties will try to resolve any dispute in good faith; failing that, they submit to the ordinary courts of the City of Buenos Aires.
